SUMMARY
Supreme Court’s interpretation of the contract implementation place as specified in Art. 34 of the Code
of Civil Procedure – critical remarks
The article presents a critical reflection on the interpretation of Art. 34 of the Code of Civil Procedure made in the decision of the Supreme Court of 8 November 1991 (II CO 16/91) and its resolution of 14 February 2002 (III CZP 81/01). The similarity of the notions „contract implementation place” specified in Art. 34 of the Code
of Civil Procedure and „place of performance” specified in Art. 454 of the Civil Code adopted by the Supreme Court is questioned basing on the results of the linguistic and systemic analysis and the interpretation of intent of those provisions and with reference to an exemplary case illustrating the adverse consequences
of the interpretation made by the Supreme Court. It is also suggested that Art. 34 of the Code of Civil Procedure should be interpreted more narrowly than it is done today: „contract implementation place” should be understood as the place where the performance characteristic of a given contract is to be implemented,
with the exception of a pecuniary performance.
